As a condition of using the EzAuto website, you warrant to EzAuto that you will not use the company website for any purpose that is deemed unlawful or prohibited by law and or in these terms, conditions, and notices. You are prohibited to use the company website in any manner which could damage, disable or impair the company website or interfere with other parties' use of the website and the enjoyment of the Company website.
EzAuto as an online Rent to Own platform will ask you to fill in your bank details and in order to make payments towards your car rental and may require you to make a payment through the website. If we agree to accept your payment by debit or credit card, payment will be processed through the EzAuto website by means of entering your account details. You will be responsible for the transactional fees, levied against EzAuto, arising from your use of a debit or credit card to make a payment. We cannot guarantee that the EzAuto website will always be available. We do not warrant, continued availability or uninterrupted access to the website. You hereby indemnify us against any losses, damages, costs, fees, charges or liabilities which you may incur as a result of any delay or inability to effect an online credit or debit card payment caused by the website being temporarily or permanently inaccessible or unavailable. In the instance of effecting an online credit or debit payment for any reason you are obliged to meet your payment obligations to EzAuto using other means of payment, for example, electronic funds transfers, cash deposits or check deposits where acceptable. Your payment, bank, card, and details will be held with the strictest confidence We undertake that we have taken all the necessary precautions to secure the debit credit card processing that is carried out online through the EzAuto website. EzAuto cannot be held responsible for a breach of confidential information occurring on your personal or devices used to browse the EzAuto website or to make payments EzAuto. This may result due to the lack of adequate anti-viral software, or spyware programs that you may have inadvertently downloaded.
In accordance with the Financial Intelligence centre Act, 2001 (FICA) we are required to take steps towards the prevention of money laundering. We do this by verifying each customer’s identity. As a part of our anti-money laundering obligations under FICA, we may monitor funds moving into and out of your account, and provide reports of any suspicious movements of funds, for example, funds added and removed, to the Financial intelligence centre. We also reserve the right to close your account, if we have reason to believe that you are depositing and withdrawing funds from your account (whether by means of credit or debit card transaction or other payment) for purposes other than trading with us and further levy penalty of 2.5% (excluding VAT) on all deposits and withdrawals which we deem to be made other than for the purpose of trading with us. In addition, EzAuto has employed the means to and internal controls to manage risk, and fraud, in line with good business practice, which prescribes to minimise the risk of loss to our clients that result from any irregularity, fraud, or error and detecting any irregularity, fraud or error should they occur and apply prompt remedial action. In line with what is said, EzAuto will not allow payments from clients' accounts held with EzAuto to third parties. In order to manage this process, you are required to provide EzAuto with your new account details and said account would only be able to receive a payment from the specific client account if the details of the account are matched with the client's name and details.
EzAuto features communication boards, forums, chat services, community personal web pages, calendars, and or other communication facilities enabling you to communicate with the public, Community, EzAuto representatives, or individuals, you agree the communication service is only to post, send and receive messages and materials that are proper and related to the particular service, you will not.
EzAuto reserves the right to monitor the use of EzAuto communication portals for private, public, or group discussions, remove and refuse information at the discretion of EzAuto. EzAuto reserves the right to terminate your access to any or control of all of the communication services at any time without notice for any reason whatsoever related to the EzAuto website and subsidiary social channels. EzAuto also reserves the right at all times to disclose information as necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or part, at its sole discretion. These terms and conditions are governed and constituted in accordance to the law of the Republic of South Africa If any dispute arises in relation to the terms and conditions set herein contract, and website, will be resolved in the South African courts, South African courts will have the exclusive jurisdiction to determine any matter or dispute. You agree that there is no joint venture, partnership or agency relationship that exists between yourself and EzAuto, as a result of these terms of use or the use of our services. If any part of these terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect. Unless otherwise specified herein, these terms constitute the entire agreement between the user and EzAuto with respect to the EzAuto Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and EzAuto with respect to the EzAuto Website. A printed version of these terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that these terms and all related documents are drawn up in English.

a. Pre-Approval Process: The pre-approval process is designed to provide an initial indication of eligibility for our rent-to-own vehicle program. Pre-approvals are subject to further review and verification.
b. Deposit Requirement: Pre-approvals are not considered valid until a deposit is paid by the client. The amount of the deposit will be specified during the pre-approval process.
c. EzAuto’s Discretion: EzAuto PTY LTD reserves the right, at its sole discretion, to not proceed with the transaction if the client fails to meet any additional criteria or if any information provided during the pre-approval process is found to be inaccurate or incomplete. In such cases, the deposit will be refunded to the client.
d. Limitation of Liability: By participating in the pre-approval process, clients acknowledge and agree that EzAuto PTY LTD is released from any liability or risk associated with the decision to not proceed with the transaction. Clients agree that EzAuto PTY LTD will not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to the pre-approval process or any subsequent decision to not proceed with the transaction.
